Terms & Conditions of Booking with Lazy Vacation

When you make a booking with Lazy Vacation Ltd you're agreeing to our terms & conditions outlined below.

1. Booking
Your travel arrangements must be arranged directly with Lazy Vacation Ltd, and all correspondence will be sent to the address specified on your confirmation invoice. All flight tickets issued on our website are issued by our affiliate office Benz Travel LTD.
The person who makes the booking, who must be aged 18 or over, accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party.

2. Payment
The appropriate deposit/payment must be sent, and if insurance is required, the correct insurance premium. The balance of payment due must be received by at least 8 weeks prior to departure if a deposit is accepted by us and paid. If payment is not received by the due date, Lazy Vacation Ltd reserves the right to cancel the booking and / or apply cancellation charges. Take note that payment terms vary with different suppliers, full terms and conditions will be made aware to you at the time of booking.

3. Price
The price of your booking is that shown on your confirmation invoice, and may be subject to fluctuations if not paid for in full. Bookings that are paid for in full will not be liable to any fluctuations.  Lazy Vacation Ltd reserves its rights to pass on any fluctuation of exchange rates, transport costs including the cost of fuel, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports.

Once payment has been made and a confirmation invoice and email has been sent, you have entered into a legally binding contract with Lazy Vacation Ltd to supply you with travel arrangements at the fixed price quoted by Lazy Vacation Ltd. Prices quoted include service charges, and in some cases premiums are added to airfares at an agreed price at the time of booking according to supply and demand.

The price you pay is fixed, and Lazy Vacation Ltd will in no uncertain terms deviate on the fixed price if you change your mind or find a cheaper deal after entering into a contract with Lazy Vacation Ltd. It is your responsibility to to monitor the market for the best deal before you book & enter into a contract with Lazy Vacation Ltd.

4. Cancellation by you
If you wish to cancel your travel arrangements, the lead name on the confirmation invoice must give written notification to Lazy Vacation Ltd. The date of cancellation will be the date Lazy Vacation Ltd. receives this notice. In the event of cancellation by you, no insurance premiums paid will be refunded and cancellation charges will be payable by you.

5. Cancellation 8 weeks or more

6. Cancellation within 8 weeks
100% with loss of insurance premium. If you cancel your holiday after Lazy Vacation Ltd has sent out documents, no refund (if due) will be made until all such documents are received back by Lazy Vacation Ltd. Please note that in some cases it is not possible to make refunds for any services booked but not used. Cancellation terms vary with different suppliers and are clarified at the time of booking.

7. Alterations by you
If once the booking has been accepted by Lazy Vacation Ltd you wish to make any alterations to the booking details Lazy Vacation Ltd will do all it can to assist you. The lead name on the confirmation invoice must send the written alteration request to Lazy Vacation Ltd. Take note that name changes are not allowed in general with all scheduled airlines, however tour operators and low cost airlines may be more lenient by allowing this with administration fees. . Changes of dates are considered a cancellation and rebook with all scheduled airlines,  and hence incur charges as set out in 4 and 15. Note that some suppliers do not allow changes to names and most tickets are non transferable, whilst some tour operators and low cost airlines are more lenient. It is your responsibility to ensure that you are aware of the terms and conditions of the airline or operator that you are booking with, before entering a contract with Lazy Vacation Ltd, and we will assist you by making you aware of these terms at the time of booking, and on  your confirmation / invoice.

8. Cancellation by Lazy Vacation Ltd
We will not cancel your travel arrangements after the date when the balance of the booking price is due. Unless we have to do so as a result of the reason referred to in paragraph 9 below, or unless payment is not received by Lazy Vacation Ltd by the due date. Subject to this Lazy Vacation Ltd reserves the right to cancel your booking in its absolute discretion on or after the date when payment of the balance of the holiday price becomes due, if not paid. In the event of cancellation by Lazy Vacation Ltd for operational reasons: we will inform you as soon as reasonably possible and you will be offered a choice of alternative holiday of comparable standard if available, or a full refund of any money you have paid.

9. Alterations by Lazy Vacation Ltd
It's unlikely that Lazy Vacation Ltd will have to make any changes to your booking, but as arrangements have to be planned well in advance, in the event that minor changes have to be made, Lazy Vacation Ltd reserves the right to do so. Should it be necessary for Lazy Vacation Ltd to make a material change to your booking, (which it reserves its right in its absolute discretion to do so) Lazy Vacation Ltd will inform you as soon as reasonably possible.

10. Travel
All transport by air, land or sea is subject to the terms and conditions of the company providing the transport, some of which limit or exclude liability. Carrier's terms and conditions is often the subject of international agreements.

11. Force Majeure
Lazy Vacation Ltd accepts no responsibility for and shall not be liable in respect of any loss, damage, alterations, delays, or changes arising from circumstances outside its control, i.e., disputes, terrorist activity, natural and nuclear disaster, fire or adverse weather conditions, technical problems with transport, closure or congestion of airport or ports, financial failure of airlines, hotels, villa and apartment owners.

12. Jurisdiction
This agreement shall be governed by and construed in accordance with the law of England and Wales. Any dispute hereunder shall be subject to the exclusive jurisdiction of the English courts.

13. Travel Documents
When travel documents are necessary to comply with the requirements of any country to which the relevant holiday relates, then it will be your responsibility to procure them. The carrier has the right to refuse carriage for any person or persons having incorrect documentation, i.e. visas, inoculations, passports etc.

Lazy Vacation Ltd will not accept any liabilities as a result of non compliance of correct travel documentation for the journey you have booked, it is your responsibility to check this, and Lazy Vacation Ltd will assist you if you are uncertain of visa, passport or inoculation requirements.

14. Operations
These holidays are operated on the terms and conditions of our Travel Trust Association membership. Full details of your financial protection can be viewed at www.traveltrust.co.uk Lazy Vacation Ltd act as retail agents of ATOL holders. Flights booked by Lazy Vacation Ltd are ATOL protected.

(Reservation cancellation charges are an administration fee charged by Lazy Vacation Ltd. This charge is separate, and over and above the cancellation fee charged by the airline, or tour operator which will be stated on your confirmation / invoice )

16. Passports / Visas & Health requirements
Please ensure that your passport, visa and health requirements are in order before you travel. Lazy Vacation Ltd is not responsible for these requirements and you should ensure that all your travel documentation is in order prior to travel. Lazy Vacation will do all possible to assist and advise you if necessary. Lazy Vacation accepts no responsibility for non compliance of health requirements, consult your GP before travel.

17. Credit card charges
Whilst we are happy to accept credit cards, we reserve the right to charge a 2% surcharge on credit card payments, in light of increased surcharges enforced on retailers by the credit card companies. American Express cards carry a 3.5% surcharge, whilst debit cards carry no surcharges.

18. Refunds
Lazy Vacation Ltd reserves the right to charge a service fee when claiming refunds from airlines on behalf of passengers, to cover our administration costs. This fee will vary, and will be proportionate to the circumstances and costs incurred when processing the refund.

19. Prohibitions
Any fraudulent or illegal activity in any bookings placed with Lazy Vacation Ltd will be reported to an appropriate law-enforcement agency, and Lazy Vacation Ltd will cooperate fully in ensuring the prosecution of offenders.

20. Complaints
If a problem occurs, whilst you are abroad, you must inform the relevant supplier (e.g. hotel, tour operator, car rental company, airline) immediately so that the matter can be put right. If the supplier cannot resolve the problem to your satisfaction, at the time, you must also contact us immediately by telephoning London 0208-778-4870 so that we are given the opportunity to help. In the event that a complaint cannot be resolved at the time, you must write to us within 28 days of your return, quoting your original booking reference and giving all relevant information. Failure to take these steps will hinder our ability to resolve the problem and/or investigate it fully and in consequence, any right to compensation you may have may be extinguished or reduced.

Disputes arising out of, or in connection with, this contract which cannot be amicably settled may be referred to arbitration, if the customer so wishes, via our association membership with the Travel Trust Association.

21. Miscellaneous

  1. You accept financial responsibility for all transactions made under your name or account.
  2. In order to make a purchase you must be over 18 years old be purchasing for yourself and have the legal capacity to make the transaction.
  3. You must make sure that all the information you provide to us is true and accurate.
  4. You must not use the website for speculative, false or fraudulent bookings.
  5. The transmission of threatening, defamatory, pornographic, political or racist material or any material that is otherwise unlawful is expressly prohibited.
  6. The site and any content may not be modified, copied, transmitted, distributed, sold, displayed, licensed, or reproduced in any way by you, except if you wish to make copies of the website for your own personal and non-commercial use.

In order for us to assist with your query as quickly as possible, please make sure that you have your order or invoice number before you call us. In most cases we can only discuss order information with the person who made the booking, or one of the passengers on a booking.

  1. Where your contract is not with us but with a third party supplier such as a tour operator or hotel, we may pass your credit card (or details of any other payment method allowed) and any other essential booking details to that third party. The placing of an order for any goods and services by you will constitute consent to us passing on such details.

You undertake to us that the details you give to us while using the Channels are correct in particular that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the product or service.

If there are any changes to the details supplied to us by you it is your responsibility to inform us by contacting our Customer Services as soon as possible.

  1. We won't send you e-mails which you do not want but we can't guarantee that third parties to whom your details are sent won't do so.
  2. Our Channels will not stop you from making impossible bookings such as two flights to the same place at the same time or a flight to one place and theater tickets to another at the same time. If you make that kind of booking we won't give you a refund.
  3. We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating there may be times when obvious errors occur. For example, very occasionally, this may result in a price, product or service or other detail displayed or presented on a Channel being incorrect. In this case we reserve the right to cancel that contract, but this of course will be without any liability to you.
  4. We do not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.
